What To Do If You Have Not Yet Lodged a Claim

If you have been involved in a motor vehicle accident in NSW, you should follow the steps below to prepare your claim to be submitted to the relevant CTP insurer.

STEP ONE

Report the Accident

If the police did not attend the accident or you haven't already done so, contact the Police Assistance Line on 131 444 to report the accident as soon as possible.


Ask the Police for a 'Police Event Number'. The report to the Police must be made within 28 days of the accident.

STEP TWO

Obtain a Certificate of Capacity/Fitness

Arrange an appointment with your General Practitioner (GP) to complete the Certificate of Capacity/Fitness form.


If you are in hospital this can be completed by one of the doctors overseeing your care. This document is essential for initiating your CTP claim.

STEP THREE

Submit a Personal Injury Benefits Application

Complete the Application for Personal Injury Benefits form and lodge the form and the Certificate of Capacity/Fitness form with the CTP insurer of the vehicle at fault for the accident or, if you were at fault, on your own CTP insurer.

STEP FOUR

Submit All Documentation Within 28 Days

You have a window of 28 days from the date of the accident to submit your claim to the relevant CTP insurer. Doing so within this timeframe allows you to receive back-payment for any lost wages from the date of the accident. 


For motor accidents occurring on or after 1 April 2023, the entitlement to statutory benefits to injured people who are “wholly or mostly at fault” or who have suffered a “threshold injury” is extended from 26 weeks to 52 weeks.

Ensure that you submit your claim within three months from the accident date. This deadline is crucial for initiating your claim process without needing to provide a statutory declaration setting out your reasons for submitting a claim out of time.

SUPPORTING YOUR CLAIM

Be aware that the application mentioned above doesn't encompass potential lump sum payments that you might be eligible for.
